Our services are provided on a project basis or subscription basis, as agreed in writing before the start of any engagement. Any scope, deliverables, timeline, and pricing will be confirmed in a written proposal or agreement before work begins.
3. Quotes, Payments, and Refunds
- All quotes are valid for 30 days unless stated otherwise. - Payments are processed through Stripe (card payments) or as otherwise agreed. - Flexible payment plans are available by agreement. - For subscription services, payments are due monthly in advance. - Refunds are considered case by case. Once work has begun, fees for work completed are non-refundable.
4. Your Responsibilities
To help us deliver successfully, you agree to: - Provide accurate information and materials in a timely manner. - Respond to requests for feedback within reasonable timeframes. - Ensure you have the rights to any content you provide to us. - Not use our services for illegal, harmful, or misleading purposes.
5. Intellectual Property
Upon full payment, you own the deliverables we create specifically for you (designs, videos, websites). We retain the right to: - Display completed work in our portfolio (unless you request otherwise). - Use pre-existing tools, frameworks, and templates that we own or license.
6. Confidentiality
We treat your business information as confidential. We will not share your internal data, customer lists, or business secrets with third parties, except where required by law or where needed to deliver services.
7. Limitation of Liability
While we strive for excellence, Khayal Creative is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the fees paid for the specific service in question.
8. Third-Party Services
Our work may integrate third-party services (hosting, payments, email, analytics). We are not responsible for outages, changes, or issues caused by these third parties.
9. Termination
Either party may terminate an engagement with written notice. Upon termination: - You pay for work completed up to that date. - We deliver any completed work and transfer ownership upon full payment. - Ongoing access to systems and files may end.
10. Marketing Consent
We only send marketing communications if you have explicitly opted in. You can unsubscribe at any time using the link in any marketing email or by contacting us directly.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be resolved through good-faith negotiation first, and if necessary, through the courts of England and Wales.
